Under New York's new no-fault divorce laws, passed in October of 2010, a spouse who is determined to have fewer personal assets is now entitled to seek attorneys fees as part of a temporary spousal support agreement. Previously, the spouse seeking alimony was required to show a financial need and justification for the support. With the new law, however, the courts assume that the spouse who stands to suffer the most financial damages as a result of the property settlement — referred to as the non-monied spouse — is entitled to have legal fees paid as part of the settlement.
