I'm Kevin Colwell and I've been practicing law in New York for 10 years. I've done public and private work, including a job as a family court prosecutor with the Columbia County Department of Social Services. I know the law and I know what judges and administrative law judges respond to in cases like yours.
Spousal Maintenance and Divorce: Tough Negotiations
- When a married couple divorces or separates, they must agree to a spousal maintenance arrangement to ensure that neither is left in dire financial straits. Finding a fair solution can take a lot of negotiating — and sometimes that means playing tough.
Child Support Arrangements
- With child support agreements, it's generally more straightforward. The amount of child support to be paid or received is set by a statute but your other contributions should not be ignored. It's best to have a lawyer make sure that no exemptions are ignored or claimed unfairly.
"Post-decree" Actions: Modifications and Enforcement
Do you need to change an existing child support, spousal maintenance/alimony or child custody order? I can help. If you can show there has been a substantial "change in circumstances" regarding your (or your spouse's) lifestyle or income, the court can change your arrangements.
If either party has violated an existing order, however, then the other spouse can file for "enforcement." The court can force the spouse to adhere to the rules of the decree — with wage garnishments, revoked driver's licenses and even jail time. I can help you advance or defend against an enforcement action.
