In October 2010, the state of New York dramatically changed its laws in respect to divorce. Prior to the change, one of the spouses had to claim grounds for divorce, which often placed the other party at a disadvantage in regards to the equitable distribution of marital property. The spouse being blamed for the failure of the marriage was forced to fight an uphill battle in each of the primary litigation components of a divorce case, including child custody and visitation, child support and equitable distribution of marital assets.
With the change to no-fault divorce, however, either spouse may file, without the necessity to show grounds. This places both spouses on equal grounds when determining marital and separate property and distributing property equitably. Previously the spouse with the most separate assets could file for divorce on very weak grounds, as a bargaining chip in the property settlement. Although marital property is still subject to litigation, the equation of blame has been removed. No-fault divorce now makes divorce accessible for both parties, with less concern over losing assets.
